Introduction

Junovy is committed to ensuring that illegal content is not hosted on its platform. In compliance with the Digital Services Act (Regulation (EU) 2022/2065), we have established this notice-and-takedown procedure.

This procedure allows anyone to report content they believe to be illegal under EU or Dutch law. We take these reports seriously and process them according to the timelines and procedures outlined below.


Scope

This procedure applies to all content hosted on Junovy services, including:

  • Junovy Cloud Storage
  • Junovy Team Chat
  • Junovy Sites
  • Any other Junovy Business Suite service

It covers content that is illegal under EU law or the laws of The Netherlands, including but not limited to:

  • Child sexual abuse material (CSAM)
  • Terrorist content
  • Intellectual property infringement
  • Illegal hate speech
  • Fraud and scam content
  • Malware distribution

How to Submit a Notice

Notices should be sent to: abuse@junovy.com

A valid notice must contain the following information (per DSA Article 16):

  • A sufficiently substantiated explanation of the reasons why the content is alleged to be illegal
  • A clear indication of the exact electronic location of the content (URL or other identifier)
  • The name and email address of the person or organisation submitting the notice
  • A statement confirming the good faith belief that the information and allegations are accurate and complete

Notices that do not contain sufficient information may be rejected. We will inform you if this is the case so you can resubmit with additional details.


Processing Timeline

Initial assessment Within 48 hours
Decision and action (standard cases) Within 7 calendar days
Decision and action (manifestly illegal content such as CSAM, terrorist content) Within 24 hours
Notification to content provider Within 24 hours of action taken
Notification to reporter Within 7 days of decision

Actions We May Take

After assessment, we may take any of the following actions:

  • Remove or disable access to the content
  • Suspend the account responsible for the content
  • Restrict the visibility of the content
  • Take no action if the content is not found to be illegal, with reasons communicated to the reporter

All decisions are made by qualified staff. We do not use fully automated decision-making for content moderation.


Counter-Notice (Content Provider's Rights)

If your content has been removed or restricted, you will be notified with:

  • The action taken and the reasons for it
  • Information about the notice that led to the action (unless disclosure would compromise an investigation)
  • How to submit a counter-notice

You may submit a counter-notice to abuse@junovy.com explaining why the content should be restored. Counter-notices are assessed within 7 calendar days. If the counter-notice is successful, the content will be restored.


Complaints Mechanism (DSA Article 20)

If you disagree with a decision we have made regarding content moderation, you may submit a complaint to abuse@junovy.com.

Complaints are reviewed by a different staff member from the one who made the original decision. We aim to resolve complaints within 14 calendar days.

If you remain unsatisfied, you may refer the matter to a certified out-of-court dispute settlement body or the competent court.


Reporting to Authorities

We are obliged to report certain types of illegal content to the relevant authorities, including:

  • CSAM to the National Center for Missing & Exploited Children (NCMEC) and Dutch police
  • Terrorist content to the relevant national authorities

We will cooperate with law enforcement where required by law.


Automated Detection

Junovy uses automated malware scanning (ClamAV) for all uploaded files. This is signature-based detection only and does not constitute general monitoring of content. For details on our scanning practices, see our Privacy Policy Section 4a and our DPIA: File Scanning.
